This document describes in detail the changes in ownership that have occurred in the Beall Springs Reservation since its inception.  A summary is also available.

Hypothesis: Missouri's 1/8 interest in the Reservation is divided equally among her husband and children, giving each a 1/56 interest, as tenants in common.  Miss Anna Beall's 1908 petition for partition claims that this was the case.  The children are:

  • Rose Baker (later married Col. R. E. L. Whitworth between 1910 and 1914)

Petition from Miss Anna Beall to the Georgia State Superior Court to partition the Reservation.
Petition and Summons in the possession of Ruth Baker Avirett as of 12 May 2003#
This petition is scheduled for the Apr 1908 term of the court (and continued several times, the last being an indefinate continuation on 7 Oct 1910), but is apparently never granted (since Anna later uses her 3/8 interest as part of loan collateral in 1911).  It does, however, list Anna's belief about where the shares are at this time, which agrees with the entry above.  NOTE: The petition incorrectly states that Frances sold her interest directly to Anna, but there is documentation for the sale from Frances to J. C. A. and that Anna then inherited J. C. A.'s estate.

The purpose for this 'sale' is to secure a loan, which is later repaid, so there was no actual transfer of interest.  The recorded deed is overwritten with the following:
The debt this deed secures has been tendered and new security deed given to secure property on same.  The Clerk of Warren Co. court is hereby authorized to cancel same on record June 8 1920.

The inventory of Florrie Baker's estate includes the following two lines:
"1/6 undivided interest in property of G. W. Baker, Estate
 1/5 of 1/3 of property in name of Mammie (sic) Baker, Oscar Baker, Rose B. Whitworth"
The first of these refers to Florrie's interest received from her mother (via her father's estate) on 15 Jan 1925.  The second refers to her inherited interest (1/5, shared with her living siblings) of Oscar Baker's share (1/3) of the purchase made at auction on 26 Mar 1929.  This confirms that the auction purchase was made only on behalf of the three documented purchasers and not on behalf of all six siblings.

Georgia DOT paves the road to the north and east of the Reservation, increasing the right-of-way width to 80 feet and reducing the taxed size of the reservation by 1.416 acres to 11.573 acres.  (This implies an initial size of 12.989 acres.)  A check for $250 to compensate is sent to Nesbit Baker, but he does not know how to allocate it among the owners and it remains uncashed.

16 Mar 1982 A land survey of adjacent land commissioned by Ruth Avirett and Joyce Hardzog incidentally shows the size of the Reservation to be 11.17 acres, about .4 acres less than the total of all taxed shares.  This discrepancy remains unexplained.  The survey makes note of existing concrete corner markers at the NW and SE corners of the property, but places new iron-pipe markers at those corners.  The locations of both of the new markers reduce the acreage of the Reservation.  The basis for revising the location of these corners is unknown.
